Is Chron's Seen As A Disability?!!!!

The guidelines for Social Security disability and Americans with Disabilities Act (or Rehabilitation Act) disability are quite different. I know next to nothing about the SS disability definitions. My impression is that they’re a lot more restrictive, but probably easier to prove if you fall into a neat category. The guidelines for the ADA and Rehabilitation Act (which focus on preventing discrimination rather than providing income) are very broad. On their face they could include almost anyone, including people who have no current disability but have a record of having had one or who are perceived as having one. A disability under the ADA can be harder to establish partly because the guidelines are so nebulous. Nancy

There are no lists of included disabilities – it varies by jurisdiction & by the impact the particular disability has on an individual. I’ve run across cases which have gone both ways. I’m paraphrasing here (since I don’t have the act in front of me) but basically you have to show that the disability affects the performance of one or more major life functions (breathing, eating, working, etc. – again – no set list) I’m not doing a complete run down here, since I’ve posted that a couple of times in the past & I don’t want to wear out my welcome. If you want references to the Act let me know – I can point you in the right direction. There are publicly funded entities whose job it is to process complaints under the ADA. Nancy

Hi Everyone, I unfortunately am on disability due to the severeity of my Crohns Disease. I have been declared totally disabled in 1990 and still am as well as on Social Security Disability. I also fall thru the cracks of the system as far as Medicaid is concerned due to my wages I made while living in NY so the only way my prescriptions are paid for is through either my pocket/my folks help when they can and my boyfriend helps also as he doesn’t like to see me suffer in pain so he would rather pay for my prescription(s) than see me in pain. I also do know a few people on disability due to Crohns other than myself and I do believe that Crohns is on the list as being one of the diseases listed as a disability but check with Nancy or an attorney or even the Social Security Office. This is : just in case she has an attack during a test or misses material due : to being incapacitated. I told her about this from reading something : in this newsgroup in August. It has relieved her mind and the person : in charge of the disabilities office gave her two options. Inform : all teachers ahead of time, or alternatively he would inform them if : her condition causes her to miss something. He said that in ten years : he only had to strongly talk to a teacher to get them to be reasonable. : She chose the second option because she is very private. Hope this : helps. I have crohns and the diagnosis qualified me for long term disability under my company’s long term disability policy. My doctor, of course, has to certify how disabled I am from it, but they’ve never questioned the fact that crohns is a qualifying, disabling condition. Hope this helps Ellen

Is Chron’s Disease listed as a disability under the American with
Disabilities Act??<< The definition of disability under the ADA is quite nebulous – "A physical or mental impairment that substantially limits one or more of the major life activities of such individual." Major life activities include (but are not limited to) such things as caring for oneself, walking, seeing hearing, breathing, learning and working. You could probably make a good solid argument that crohns is a disability. Ask your (landlord, employer, school) for an accomodation – they might be quite willing. If you meet with resistance, and believe you are being discriminated against, contact your local Civil Rights Commission or an attorney. Both can also give you information about the ADA. Or you can go hang out at your local law library – it’s ton’s of fun! Seriously, law libraries attached to universities are often open to the public and the librarians are used to helping do-it-yourselfers find reference materials (42 USC secs. 12111 et seq is where you’ll find the ADA, and 29 CFR sec. 1630 has the Regulations issued by the Equal Employment Opportunities Commission – for those really into a bit of research) Disclaimer: I am not an attorney; as a second year law student I know just enough to be dangerous.
